Court dismisses appealThe Court of Appeal has dismissed an appeal brought by the Mangawhai Ratepayers and Residents Association (MRRA) against a High Court ruling regarding rates levied for the Kaipara District Council’s Mangawhai Community Wastewater Scheme (MCWWS). The ruling, released last Thursday, has found in favour of the Council and the Court of Appeal has also ruled the MRRA must pay the Council’s costs. Chair of Commissioners, John Robertson, welcomed the Court’s decision. “We are still studying the detail of the decision, but we’re pleased with the outcome,” Mr Robertson says. “Our focus now is on Kaipara’s future and preparing for next year’s Council elections.” The MRRA initially applied in 2013 to the High Court for a judicial review regarding the question of the legality of rates levied to fund the wastewater scheme. The case was heard in February 2014. Last week’s ruling is a result of the MRRA’s appeal against aspects of the High Court’s decision. |
